Welcome to the website (“Site”) of Legacy Security Technology, Inc. (“LST”). LST and its affiliates provide their services to you (“User”) subject to the following terms and conditions (“Terms of Use”). By using the Site User agrees to be bound by these Terms of Use. Please read them carefully. In addition, when User uses any current or future LST service or visits or purchases from any business affiliated with LST, whether or not included in the Site, User will also be subject to the terms and conditions applicable to such service or business.
User Conduct
User agrees to use the Site only for lawful purposes and in accordance
with all applicable laws. User is prohibited from posting on or
transmitting through the Site any unlawful, harmful, threatening,
abusive, harassing, defamatory, vulgar, obscene, sexually explicit,
profane, hateful, racially, ethnically, or otherwise objectionable
material of any kind, including but not limited to any material that
encourages conduct that would constitute a criminal offense, give rise
to civil liability, or otherwise violate any applicable local, state,
national, or international law.
User acknowledges that the Site contains images, text, and other materials (“Content”) that are protected by copyrights, trademarks, trade secrets, or other proprietary rights, and that these rights are valid and protected in all forms, media and technologies existing now or hereinafter developed. All Content is copyrighted as a collective work under the U.S. copyright laws, and LST owns a copyright in the selection, coordination, arrangement, and enhancement of such Content. User may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the Content, in whole or in part. Except as provided in the preceding sentence or as permitted by the fair use privilege under the U.S. copyright laws (see, e.g., 17 U.S.C. Section 107), User may not upload, post, reproduce, or distribute in any way Content protected by copyright, or other proprietary right, without obtaining permission of the owner of the copyright or other propriety right. In addition to the foregoing, use of any software shall be governed by the software license agreement accompanying such software.
LST does not intend the Site to be used by individuals under the age of 18 (a "Minor") without the supervision of a parent or guardian 18 years of age or older (a "Guardian"). LST relies upon Guardians to determine if any Content or items available on the Site is appropriate for the viewing, access or purchase by such Minors. If a User is a Minor, such Minor may use the Site only under the supervision of Guardian.
Product Colors
The Site attempts to display product images as accurately as possible.
However, LST cannot guarantee that the color User sees matches the
product color, as the display of the color depends, in part, upon the
monitor the User is using.
Prices
The price for an item on the Site may differ from the price shown in a
User's shopping cart -- it is possible that such price may increase or
decrease between the time the item is placed in a shopping cart and the
time that the purchase is actually made. On rare occasions, an item may
be priced incorrectly on the Site. If the price for the item is
incorrect and is actually higher than the price provided at the time of
purchase, then, at the sole discretion of LST, LST may either (a)
contact the User for instructions before shipping the item or charging
the User for such item; (b) cancel the order for such item and notify
the User of such cancellation; or (c) ship the item at the lower
price to the benefit of the User.
Order Acceptance
User’s receipt of an electronic or other form of order confirmation
does not signify our acceptance of User’s order, nor does it constitute
confirmation of our offer to sell. LST reserves the right at any time
after receipt of an order to accept or decline an order for any reason.
Alarm Monitoring
If User purchases Alarm Monitoring Service from the Site, User must
sign and return Subscriber Alarm Monitoring Agreement upon receipt of
purchased products. LST SHALL NOT ACTIVATE ALARM MONITORING
SERVICE UNTIL RECEIPT OF SUBSCRIBER ALARM MONITORING AGREEMENT SIGNED
BY USER. Alarm Monitoring Services purchased on the
Site are provided by a third party and are not governed by these Terms
of Use. LST accepts no responsibility or liability for any
damages User suffers in connection with the use of Alarm Monitoring
Services, LST makes no representation regarding the quality or
reliability of such services.
Disclaimer of Warranties and Limitation Liability
The Site is provided on an “as is” and “as available” basis.
LST makes no representations or warranties of any kind, express or
implied, as to the operation of the Site, Content, or products sold on
the Site. User expressly agrees that use of the Site is at
User’s sole risk.
To the full extent permissible by applicable law, LST disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. LST does not warrant that the Site, its servers, or e-mail sent from LST are free of viruses or other harmful components. LST will not be liable for any damages of any kind arising from the use of the Site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages. LST’s liability for damages of any kind arising from the use of products purchased on the Site shall be limited to the purchase price of such products, exclusive of sales taxes and shipping and handling charges.
Privacy Policy
User acknowledges, consents and agrees that LST may access, preserve,
and disclose User’s account information and content if required to do
so by law or in a good faith belief that such access preservation or
disclosure is reasonably necessary to: (a) comply with legal process;
(b) enforce the Terms of Use; (c) respond to claims that any Content
violates the rights of third-parties; (d) respond to User’s requests
for customer service; or (e) protect the rights, property, or personal
safety of LST, its customers and the public.
Indemnification
User agrees to indemnify and hold LST, and its subsidiaries,
affiliates, officers, agents, and employees, harmless from any claim or
demand, including reasonable attorneys' fees, made by any third party
due to or arising out of such User's breach of the Terms of Service or
User's violation of any law or the rights of a third party.
General Terms
LST shall not be liable for any failure to perform its obligations in
connection with any action described in the Terms of Use, if such
failure results from any act of God, riot, war, civil unrest, flood,
earthquake, or other cause beyond such party's reasonable control
(including any mechanical, electronic, or communications failure).
The Terms of Use shall be governed and construed in accordance with the laws (other than its law dealing with conflicts of law) of the United States and the State of Minnesota and User consents to the exclusive jurisdiction of the state courts and U.S. federal courts located there for any dispute arising out of the Terms of Use.
LST reserves the right to make changes to the Site, posted polices, and Terms of Use at any time without notice.
The section titles in the Terms of Use are for convenience only and have no legal or contractual effect.
If any provision of the Terms of Use, or any portion thereof, is held to be invalid and unenforceable, then the remainder of the Terms of Use shall nevertheless remain in full force and effect.
